Pergola, carport and garden room approvals in Dubai

The short answer

In a Dubai master community, a pergola, carport, shade or garden room needs your master developer's approval before work starts. Emaar lists pergola installation as home modification work that needs its NOC, and Nakheel requires a NOC from its Urban Planning team for any alteration. The permit authority for your area, such as Dubai Municipality, Trakhees or Dubai Development Authority, may also need to approve it.

Who approves what

Master developers

  • Emaar: any alteration to the villa has to be approved by Emaar, and external modifications that change the look of the villas are not permitted. Emaar's contractor permit factsheet lists pergola installation, planter boxes, side garden gates and fences as types of home modification work. Apply through Home Modifications in your community portal. See Emaar home modification NOC.
  • Nakheel: you need a NOC from Nakheel's Urban Planning team before any alteration, and changes must not affect the facade or structure. Construction, modification and extension work needs both a Nakheel NOC and a Trakhees NOC. See Nakheel home modification NOC.
  • Meraas: modification NOCs are split into major and minor. Minor modification NOCs are free and take 2 to 3 working days. Major modification NOCs take 10 working days and carry an administrative fee. Meraas does not publish which works fall in each group.
  • Other developers run their own NOC processes. We could not find published outdoor-structure rules for DAMAC, Dubai Properties, Nshama or Majid Al Futtaim. Ask your community management team.

Permit authorities

  • Dubai Municipality (most mainland plots): the permit for modifications and additions is applied for through the Building Permit System. According to dubizzle's summary of the service, fees for minor modifications after completion include 15 fils per sq ft of outdoor pergola area, 30 fils per sq ft for pools and other external services, and 30 fils per sq ft of internal floor area.
  • Trakhees (Nakheel areas and other special zones): any modification to a completed building in its area needs a Modification Permit before work starts.
  • Dubai Development Authority (TECOM areas): a Building Modification Permit for completed buildings costs AED 1 per sq ft of additional or relevant built-up area, with an estimated delivery time of 2 working days.
  • RTA: a permit to install parking shades in designated, reserved parking spaces in residential neighbourhoods, launched in January 2026.

"Check with" means we could not find a published rule. It does not mean no approval is needed.

Step by step

  1. Find your master developer and permit authority. Your community page shows both where they are known.
  2. Read your developer's home modification guidelines. Emaar publishes its Home Modification Guide in the residents' portal.
  3. Have a licensed consultant draw the structure if it needs a permit.
  4. Apply for the developer NOC: the Emaar community portal, Nakheel Online Services or the My Nakheel app, or 800Meraas.
  5. Once the NOC is issued, apply for the authority permit if the work needs one.
  6. Your contractor applies for a site access permit. Emaar emails the contractor a reference number after the NOC, and Nakheel asks for the Nakheel and Trakhees NOCs.
  7. Build to the approved drawings and close out any completion inspection.

Common reasons for rejection

  • The design changes how the villa looks. Emaar does not permit external modifications that change the villas' aesthetics.
  • It affects the facade or structure. Nakheel allows changes only where they do not.
  • The application is incomplete. Trakhees can reject a submission that is not complete against its checklist, and sends it back for correction if engineers find major problems.
  • No approved drawings. Trakhees needs the latest stamped drawings of the property, or "As Existing" drawings if it has none on file.
  • Built without a NOC. Meraas says it issues a violation notice with a time frame to remove the modification.

Older reporting points the same way. Gulf News reported in 2018 that Emaar's Emirates Living communities allowed pergolas and shades on the villa exterior only in the same wooden material. Check current rules with your developer.
